| Memorandum
of Understanding (MOU)
FACT
recognises the need to work in partnership if
we are to succeed in effectively tackling the
Prevention and Detection of Intellectual Property
(IP) crime. We achieve this, in part, through
Memorandums of Understanding (MOU) or Information
Sharing Agreements (ISA's) with private/public
organisations and government bodies.
The primary purpose of this is to act as a focal
point for:
- Building
knowledge on each others business areas;

The generation of ideas;

Sharing best practice;
- Contributing
to preventing and detecting crime
- Contributing
to reducing loss to the Film and Broadcasting
Industry.
- Contributing
to preventing financial gain to Organised Criminals
Groups involved in Copyright theft.
FACT
is a law enforcement body whose primary purpose
is to protect the UK's film and broadcasting industry
against counterfeiting, copyright and trademark
infringement. We support law enforcement agencies
and facilitate the investigation and prosecution
of those involved in these types of offences.
Primary legislation includes the Trades Marks
Act 1994 and the Copyright Designs and Patents
Act 1988.
Our
relationships are based on mutual understanding,
trust and collaboration. This means that we will:
- Work
together to reach agreements on priorities and
plans ensuring transparency of intentions and
actions;

Consider carefully how we are able to work together
both proactively and in response to requests;

Consider and test new ways of working so that
we can improve our effectiveness;

Conduct regular joint reviews of how the relationship
is working, identifying and building on areas
of good practice;

Safeguard sensitive information and assets against
unauthorised disclosure or compromise by ensuring
there is a robust monitoring and audit regime;

Share problems and concerns at the earliest
opportunity and take positive steps to address
them; and
-
Seek to avoid duplication and conflict by ensuring
that activities are Non-competitive.
