Section 35 powers of criminal
courts act 1973 empowers any court to order an
accused to pay compensation in respect of any
loss or damage resulting from the offence of which
the accused has been convicted. However, the court
of appeal (r v vivian 68 cr app r53) have held
that no compensation order should be made unless
the sum claimed is either agreed or simply proved.
The courts have been discouraged from embarking
on complicated investigations, preferring to leave
the victim to his civil remedies. Accordingly,
compensation is rarely relevant in cases involving
breach of copyright.
